Welcome to MALKARI by Tali. These Terms of Service (“Terms”) govern your access to and use of malkaribytali.com (the “Site”) and any purchases or services made through it.
By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. About Us
MALKARI by Tali (“MALKARI,” “we,” “us,” or “our”) is a jewelry brand operated by Televiv Couture, LLC, located at 30 East Huron, Suite 2005, Chicago, IL 60611, USA.
2. Eligibility
You must be at least 18 years old to make a purchase on this Site. By placing an order, you represent that you are of legal age and have the legal capacity to enter into a binding contract.
3. Account Registration
You may browse the Site without an account, but certain features (saved addresses, order history) require registration.
- You agree to provide accurate, current, and complete information when registering
- You are responsible for keeping your password confidential
- You are responsible for all activity that occurs under your account
- Notify us immediately at malkari@talikogan.com if you suspect unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms or appear fraudulent.
4. Products and Pricing
- All prices are listed in U.S. Dollars (USD)
- Prices are subject to change without notice
- We do our best to display product photos accurately, but actual colors and details may vary slightly due to monitor settings and natural variation in materials (especially semi-precious stones)
- Product availability is not guaranteed — we reserve the right to limit quantities, refuse orders, or discontinue products at any time
- In the event of a pricing error, we may cancel the affected order before shipment and refund any payment made
5. Orders and Payment
Placing an order
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order. An order is confirmed once we send you an order confirmation email.
Payment
- We accept payment through Stripe (credit/debit cards) and Klarna (buy-now-pay-later)
- You authorize us to charge your chosen payment method for the total amount of your order, including taxes and shipping
- All payment information is processed securely by our payment providers — we do not store credit card details on our servers
Sales tax
Sales tax is calculated at checkout based on your shipping address and applicable state and local tax laws.
Order cancellation
You may request order cancellation by emailing malkari@talikogan.com within 24 hours of placing the order. Once an order has been processed for shipment, it cannot be canceled but may be returned per our Return Policy.
6. Shipping
Shipping terms, costs, and timelines are detailed in our Shipping Policy. All shipping risk transfers to the buyer upon carrier handoff. International orders may be subject to customs duties, taxes, and fees, which are the buyer’s responsibility.
7. Returns and Exchanges
Returns and exchanges are governed by our Return Policy. Sale items are final sale. International orders are final sale and not eligible for return.
8. Intellectual Property
All content on this Site, including product photographs, jewelry designs, logos, text, graphics, and the MALKARI by Tali name, is owned by Tali Kogan and/or Televiv Couture, LLC or used with permission, and is protected by applicable U.S. and international copyright, trademark, and other intellectual property laws.
You may not:
- Copy, reproduce, distribute, or republish our content without prior written permission.
- Use our images or jewelry designs for commercial purposes.
- Reverse engineer, copy, or imitate our jewelry designs.
- Use our name, logos, branding, or other identifying elements in any manner that suggests sponsorship, affiliation, or endorsement without our prior written permission.
Personal, non commercial sharing on social media with appropriate credit is welcomed and encouraged.
9. User Content
If you submit content to the Site (reviews, photos, comments, etc.):
- You retain ownership of your content
- You grant MALKARI a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with our business and marketing
- You represent that you own or have permission to share the content
- You agree not to submit anything unlawful, offensive, infringing, or defamatory
We reserve the right to remove any user content at our discretion.
10. Prohibited Uses
You agree not to:
- Use the Site for any illegal purpose
- Attempt to gain unauthorized access to our systems, accounts, or data
- Use bots, scrapers, or automated tools to harvest data from the Site
- Interfere with the Site’s operation, security, or other users’ experience
- Submit false, misleading, or fraudulent information
- Engage in commercial competitive analysis of our pricing or inventory
Violations may result in account termination and legal action.
11. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.
We do not warrant that:
- The Site will be uninterrupted or error-free
- Defects will be corrected
- The Site or servers are free of viruses or harmful components
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MALKARI BY TALI, TALI KOGAN, Televiv Couture, LLC AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM:
- Your use of or inability to use the Site
- Any product purchased through the Site
- Unauthorized access to your data
- Any third-party content or services
Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless MALKARI by Tali, Tali Kogan, Televiv Couture, LLC and our employees, agents, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of:
- Your use of the Site
- Your violation of these Terms
- Your violation of any third-party rights
14. Governing Law and Jurisdiction
These Terms are governed by and construed under the laws of the State of Illinois, USA, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction in those courts.
15. Dispute Resolution
Before initiating any legal action, you agree to first contact us at malkari@talikogan.com and attempt to resolve the dispute in good faith for at least 30 days.
If the dispute is not resolved within 30 days, either party may pursue resolution in court as outlined in Section 14.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, along with our Privacy Policy, Return Policy, and Shipping Policy, constitute the entire agreement between you and MALKARI regarding your use of the Site.
18. Changes to These Terms
We may update these Terms at any time. The “Last updated” date will reflect the most recent revision. Material changes will be communicated via email (to registered users) or by prominent notice on the Site. Continued use of the Site after changes constitutes acceptance.
